cami User Agreement

Please read all the terms of this user agreement (“Agreement”) carefully before you use the cami app to make sure you understand your rights and obligations in relation to your use of cami. cami includes the iOS application and related software features developed by us, and the intellectual property rights (including any copyright, patents, or trademarks) belong to us.

We always respect and protect the legal rights of all our users in relation to privacy and user information. Rest assured that we do our utmost to prevent your rights from being infringed when you use cami or any of our products.

This Agreement is the final and conclusive agreement between you as the user (including any natural person, legal person, or other organisation) and Hong Lin Guo and its affiliates. The terms of this Agreement are legally binding when you use cami, including any updates or modifications it may go through in the future. As stated above, we have set out all rights and obligations, including disclaimers excluding and limiting our obligations in relation to your use of cami. For minors, parents and legal guardians will need to accept the terms of this Agreement on their children’s behalf.

If you are unable to accept all the terms of this Agreement, please do not use cami.

1. Your use of cami

1.1. In relation to your use of cami, you hereby warrant that your use of cami is legal at all times and any information you provide or generate in relation to your use of the app is done so within the bounds of applicable law.

1.2. Because cami operates locally on your device without a required account, you accept sole responsibility for the physical and digital security of your Apple device. You must inform us immediately of any behaviour in relation to actual or suspected violation of law regarding our software. We do not accept liability for any losses incurred as a result of non-compliance with your obligations under this clause or unauthorized access to your device.

1.3. You are responsible for all costs relating to the purchase and use of cami, including any fees incurred for Internet or data connections required to download the app or updates. Please check the costs of any telecommunications service you may be using for full details.

2. Your license to use cami

2.1. In accordance with the terms of this Agreement, we hereby grant you a non-transferrable, non-exclusive license to download, install, and use cami on Apple-branded products that you own or control, subject to the following conditions:

2.2. You acknowledge that all relevant intellectual property rights in relation to cami are owned by Hong Lin Guo or any authorised persons at all times.

3. Your information in relation to cami

3.1. In this Agreement, “User Content” refers to content you or any user may capture, publish, or generate in relation to the use of cami, including all photos, videos, and camera overlays generated as part of cami’s features.

3.2. As part of cami’s functionalities, you are able to save User Content to your device's Photo Library or share it on social media if you choose to do so. At all times, you are solely responsible for all of your User Content. This means that you bear the risk of your User Content being disclosed to other users or members of the public once you share it outside of the app.

3.3. Because cami operates locally utilizing Apple's native kits, we do not monitor, examine, or host your User Content on our servers. We do not bear any obligation to examine or approve of any User Content being generated by users.

3.4. From time to time, you may wish to provide suggestions or feedback to us in relation to cami (“Feedback”). For all such Feedback, you assign all the rights to us and agree that we have the right to use the Feedback and related information in a reasonable way. We will treat the Feedback as non-confidential and non-proprietary. When you give Feedback, please ensure that you do not provide any information to us you consider to be confidential or proprietary.

4. Your warranties and commitment on how you use cami

4.1. You agree that when using cami and its related services, you will not do the following, and accept sole legal responsibility for any penalty, losses, or other consequences if you do:

5.1. This Agreement is effective and remains in force from the date of your acceptance (upon downloading and using the app) during the period you use cami until it is terminated in accordance with this clause.

5.2. We may terminate this Agreement at any time without notification for any reason, including but not limited to when we believe in good faith that you have breached the terms of this Agreement or upon receiving notice from a copyright holder that you have violated the copyright of a third party in relation to your use of cami.

5.3. Upon termination of this Agreement, you must cease all use of the App and delete it from your devices. We do not have any obligation to you as a result of terminating the Agreement.

6. Amendment

6.1. Your continued use of cami following notice of such amendments (provided via app updates or our website) constitutes acceptance of the amended terms of the Agreement.

6.2. We reserve the right to modify, retain, or terminate any services or features associated with cami at any time without prior notice. You acknowledge that we shall not bear any liability to you or any third party for the modification or termination of features associated with cami.

7. Third Party Services & Actions

7.1. Third Party Services. You acknowledge that our services are based on technical support and native frameworks from third parties, specifically Apple Inc. and iOS systems. Please note that this Agreement governs the rights and obligations solely between you and Hong Lin Guo. In your use of cami, you may rely on Apple's iCloud or native storage services. We do not monitor this and shall not be responsible for information or services provided by Apple, and only integrate them for your convenience. You must bear full risk on access or use of the above and are bound by any terms and policies Apple imposes.

7.2. Interaction with other users. You may share your User Content with others. We do not control such distribution and shall not be liable for any User Content. We do not have any obligation to check, monitor, or guarantee any User Content, and any risks from sharing media are borne fully by you.

8. Exclusion of Liability & Disclaimers

As permitted under Canadian law, cami, its officers, directors, employees, agents, and business partners shall not have any liability whatsoever and whether arising in contract, tort (including negligence), breach of statutory duty or otherwise, whether direct or indirect, for any loss of profit, loss of anticipated savings, loss of business, loss or damage to goodwill or reputation, or any indirect, special, consequential, exemplary, incidental, or punitive loss or damages in relation to this Agreement.

Hong Lin Guo, its affiliates, subsidiaries, officers, directors, employees, agents, and partners disclaim all warranties, whether express or implied, guarantees, or conditions with respect to your use of cami. You understand that the use of cami is on an “as is” basis, “with all faults” and “as available”. We do not guarantee that your use of cami will be timely, uninterrupted, secure, error-free, or that content loss will not occur. We do not represent or guarantee that cami will be free from loss, corruption, attacks, viruses, interference, hacking, or other security intrusions and we disclaim any liability relating to any such security intrusion.

To the extent permitted by law, we exclude all implied warranties, including fitness for a particular purpose, workmanlike effort, and product of a satisfactory quality. We may add or remove certain functions, suspend or completely stop providing cami. You hereby understand and consent that we have the right to alter, suspend, or terminate cami. We have no obligation to inform you and are not liable for any damage incurred by any user or any third party, whether direct or indirect.

You bear all risks resulting from your use of cami and disclosure of User Content. We disclaim any liability for any loss or dispute arising from a third party’s access or use of cami with your authorisation.

9. Indemnity

You agree to indemnify and hold harmless Hong Lin Guo, its directors, officers, employees, and agents from any claim or demand, including any legal costs, made by third parties arising from your breach of this Agreement, or any investigation we may conduct for suspected breach of this Agreement. You agree to help us avoid bearing any lawsuit, complaint, loss, damage, responsibility, cost, and fees (including legal fees) from any third party caused by your actions whilst using cami, your User Content, or your breach of this Agreement.

10. Privacy Policy

The cami Privacy Policy below is incorporated into and forms part of this Agreement. Please read the terms carefully and ensure that you understand all the content of the privacy policy.

11. Notifications

We may provide notifications to you from time to time via the App Store update notes, in-app notices, or to your provided email address (if you contact support). All notices issued through cami constitute effective notice.

12. Governing Law

This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Disputing parties should strive to resolve any disputes in relation to the terms of this Agreement amicably. If an amicable settlement is not possible, the disputing parties agree to submit to the non-exclusive jurisdiction of the courts of Ontario, Canada.

13. Waiver

We do not waive any rights or remedies if we fail to or delay in exercising our rights and remedies under this Agreement. We are not prevented from further exercise of our rights or remedies after exercise of a single or partial right or remedy. Any waiver of a breach or default under the terms of this Agreement shall not be deemed a waiver of any subsequent breach or default and shall not affect our rights in relation to other terms of this Agreement.

14. Severability

If any term of this Agreement is found to be invalid, illegal, or unenforceable for any reason, it will not affect the validity of any other term of this Agreement. The remaining terms of this Agreement shall remain in full force and effect.

15. Entire Agreement

This Agreement constitutes the final, entire, and exclusive agreement between you and Hong Lin Guo in relation to cami, and supersedes all prior agreement, representations, or understandings, oral or written, express or implied.

16. Assignment

You must not assign any rights or delegate any obligations arising out of this Agreement without our prior written consent. Any assignment in violation of the foregoing will be null and void.

17. Third Party Rights

A person who is not a party to this Agreement shall have no right under any legislation of any jurisdiction to enforce any of the terms of this Agreement, except that Apple and Apple’s subsidiaries are third-party beneficiaries of this Agreement, and upon your acceptance, Apple will have the right to enforce it against you.

The headings of each section are only for reference and shall not affect the legal meaning or interpretations of the terms of this Agreement.


cami Privacy Policy

Welcome aboard!

So you have downloaded cami and are starting to use our camera and overlay functionalities! Because we built cami entirely on Apple's native SwiftUI frameworks and do not utilize third-party trackers, your privacy is strictly preserved. Any information you share with us directly (such as via email support) will help us to provide you with services and improve them. We explain here our ways of collecting and using information, and how we protect your privacy. In this privacy policy, “personal data” means information that can be used to identify an individual.

What information is collected and how do we use it?

Because of the local nature of our app, we collect virtually no personal data unless you volunteer it to us outside of the app.

You have control over your information!

We recognise that privacy concerns differ from person to person. You have ultimate control over your privacy settings directly within your device's native iOS settings. You can revoke Camera and Photo Library access at any time via the iOS Settings app.

Access, Updating or Correcting Your Personal Data
Because we do not store your personal data on our servers, any media captured by the app resides on your local Apple device or in your personal iCloud. You retain full rights to access, correct, or delete this data via your device's Photos app.

Who do we share your information with?

We keep your personal information confidential. Because we do not use third-party analytics (like Google or Meta SDKs) or host user accounts, we do not share your data with marketing or analytics Third Party Service Providers.

We may disclose your personal data (such as support emails) without further consent if required or permitted by law in the following cases:

Information Safety Safeguards

We are committed to ensuring that your data is secure. Because your media never leaves your device through our app, your data is protected by Apple's strict iOS sandboxing, on-device encryption, and local security procedures. Any direct communications with us (e.g., support emails) are stored on secure servers with restricted access.

When this Privacy Policy applies

Our Privacy Policy does not apply to products and services offered by a third party. When you share media captured by cami to a third-party social media platform, they will collect your information. For this reason, we strongly suggest you read the third party’s privacy policy. We are not responsible for and cannot control how third parties use personal data which they collect from you.

Minors

We consider it the responsibility of parents to monitor their children’s use of our products and services. Nevertheless, because cami operates entirely on-device without remote data collection, it is inherently safe for minors. We do not seek or intend to seek to receive any personal data from minors. Should a parent or guardian have reasons to believe that a minor has provided us with personal data via support channels without their prior consent, please contact us to ensure that the personal data is removed.
